Destination HOPE VIP Trip Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED AS OF THE APPLICABLE DRAWING DATE DEADLINE. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

ELIGIBILITY

This Challenge and Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) states of the United States of America and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of The DONNA Foundation and their respective parent, subsidiary and/or affiliate companies (collectively, the “Promotion Parties”) as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor (defined below), whose decisions shall be final and legally binding in all respects and not subject to further review in any forum, except as provided in these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein.

TIMING

The Sweepstakes begins on October 4, 2023 at 12:00 PM Eastern Time (“ET”) and ends on November 31, 2023 at 11:59 PM ET (the “Promotion Period”). Sponsor’s database clock will be the timekeeper for this Sweepstakes.

HOW TO ENTER

Online Method: Entrants must visit https://mailchi.mp/thedonnafoundation.org/sweepstakes2024 (the “Online Website”) during the Sweepstakes Period and complete the Online Sweepstakes entry form in its entirety to receive one (1) entry into the Sweepstakes. All Online entries must be received by 11:59 PM ET on November 31, 2023.

Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. Limit: One (1) Sweepstakes entry per person during the Promotion Period.

PRIZES

A total of one (1) Prize will be awarded. Prize is One (1) Destination Hope DONNA VIP Package for two (2). ARV $2,000. Prize does not include transportation to or in Jacksonville.

PRIZE DRAWING

Sweepstakes winners will be randomly selected from all eligible entries received during the Promotion Period on December 1, 2023. The potential winners will be notified by email. Potential winners must respond to the email Notification within 5 business days of the first Notification. In the event the Potential Prize Winner fails to respond to the Notification within 5 business days of the first Notification to the potential winner or if it is determined by Sponsor, in their sole discretion, that a potential Prize Winner is not eligible in accordance with these Official Rules, an alternate Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period.

 PRIZE RESTRICTIONS

Limit of one (1) prize per person/household. Sponsor makes no representation or warranties, whether express or implied, regarding any prizes. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period.

RELEASE AND WAIVER OF LIABILITY

By participating in the Sweepstakes, each entrant hereby agrees to these Official Rules, and, on entrant’s own behalf, and on such behalf entrant’s heirs and assigns, agree to release and hold harmless Sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against all claims and damages of any kind, in whole or in part, including economic damages and personal injury (including death), directly or indirectly arising out of or in connection with your participation and/or entry in the Challenge or Sweepstakes or in any Challenge or Sweepstakes-related activity; the receipt, use, misuse, inability to use, or loss of the prize; the misdirection of the prize; and any and all claims based on rights of publicity, privacy, or defamation. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO CERTAIN ENTRANTS.

PUBLICITY

Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

GENERAL CONDITIONS

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such an event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of such provision.

LIMITATIONS OF LIABILITY

The Released Parties are not responsible for, and entrant, on its own behalf and on behalf of his or her heirs and assigns, hereby releases the Released Parties from, any claims arising from or in any way relating to: (i) miscommunications and technical failures of any kind, including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service or of any website; (iii) unauthorized human intervention in any part of the entry process or the Challenge/Sweepstakes; (iv) electronic or human error or intervention which may occur in any part of the entry process and in the administration of the Sweepstakes or the processing of entries; (v) any injury or damage to persons or property, including, but not limited to, entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Challenge/Sweepstakes or access to any material from Sponsor’s website, regardless of whether the material was prepared by Sponsor or a third party, and regardless of how the material is connected to Sponsor’s website; (vi) use of any prize; (vii) the winner selection process including the outcome of the Sweepstakes; (viii) any injury or damage to persons or property (including personal injury and death) which may be caused, directly or indirectly, in whole or in part, from the prize; (ix) incorrect or inaccurate transcription of entry information or late and incomplete entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; and (x) any costs related to the prizes, except as expressly set forth herein, including but not limited to, income, sales, property, and other taxes, fees and costs incurred by accepting the prizes. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO CERTAIN ENTRANTS.

FORCE MAJEURE

In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to, fire, flood, natural or man-made epidemic/pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, provincial or local government law, order, or regulation, public health crisis (e.g. SARS/COVID-19), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.

PRIVACY POLICY

Subject to the terms hereof, information submitted with an entry is subject to the Sponsor’s Privacy Policy, located at https://breastcancermarathon.com/privacy-policy/. By entering the Sweepstakes, entrants consent to receive emails from the Sponsor pertaining to the Sweepstakes. Entrants can opt-out to any or all future correspondence from the Sponsor by clicking the ‘unsubscribe’ button or by writing to the Sponsor. Entrants that opt-out of receiving emails from the Sponsor will not be eligible to win a prize.

CHOICE OF LAW AND DISPUTES RESOLUTION

Each entrant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. In addition, except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the State of Florida for which the courts are located in Jacksonville, Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
